Associate Professor Pei HUANG published a paper titled “The administrative regulation of metaverse: a framework analysis” in the No. 6 issue, 2022 of China Legal Science. China Legal Science is one of the authoritative journals in the law filed. This paper is also the first academic paper on the legal regulation of the metaverse published in the China Legal Science.

Abstract: The metaverse is a new generation of all-true Internet. Users, data and algorithms are the three important elements of social and economic activities in the metaverse era. Risks lies in all the three elements including the risk of hindering in-depth cooperation due to the anonymization of user identities, the risks of infringement on user’s personal information and privacy, market entities’s motivation of innovation, and national data security due to the aggregation of metaverse data, and the risks of information and data recentralization, monopoly of economic activities, and manipulation of social concepts caused by the power of metaverse algorithm. These risks are difficult to be solved by the market itself, and need to be prevented by the administrative regulation. Specific administrative regulation paths include building a unified metaverse identity authentication platform, implementing a single identity authentication system for organizational users and multiple identity authentication systems for individual users, implementing data security regulations such as mandatory user data desensitization, restricting metaverse platform companies from using commercial data to engage in inter-industry competition, and regulating cross-border data flow, algorithmic transparency regulation, algorithm ethics regulation and algorithm accountability regulation.
